I. General Information

1. These Terms and Conditions govern the rules for using the online store operated by LIOVELA s.r.o., hereinafter referred to as the "Store".

2. The following terms are used in these Terms and Conditions:

a. LIOVELA or Seller – LIOVELA s.r.o., registered office: ul. Dlha 561/67, 08901 Svidnik, Slovakia, Company ID: 53177321, Tax ID: 2121296199, VAT ID: SK2121296199, registered in the Commercial Register of the District Court Presov, insert no.: 43240/P;

b. Customer – a natural person, legal entity or organisational unit without legal personality that places an order in the Store;

c. Store – the online store operated at liovela.sk;

d. Consumer Purchase – a purchase made by a consumer or a natural person conducting business activity, provided that the purchase is not of a professional nature for that person.

3. These Terms and Conditions form an integral part of the sales contract concluded through the Store.

5. Placing an order in the Store requires prior familiarisation with these Terms and Conditions and their acceptance.

II. Product Offer

1. The Store sells products (goods) presented on the pages of the online store.

2. The Seller undertakes to deliver goods free from physical and legal defects, lawful and in accordance with the concluded contract. All products are legally placed on the Slovak market.

3. The Store does not conduct wholesale trade.

III. Rules for Using the Store

1. In the Store it is possible to:

       place orders for products,

       use individual discounts,

       participate in promotions and competitions.

2. Registration of an account in the Store is not required to make a purchase.

3. After creating an account, the Customer has access to their order history and additional features. An account can be created free of charge at: https://www.liovela.sk/registration. After registration, a confirmation will be sent to the Customer's e-mail address.

4. The Customer may delete their account at any time by contacting:

       by phone: +421 949 004 405 (from the number associated with the account).

5. The Store operates correctly when using current versions of Chrome, Firefox, Microsoft Edge, Safari or Opera browsers with JavaScript and cookies enabled.

6. Complaints regarding the functioning of the account should be sent to: liovela@liovela.com. Complaints are processed within 14 days of receipt.

IV. Placing Orders

1. Orders are accepted via the website www.liovela.sk

1.1 For businesses making wholesale purchases, the Seller operates a dedicated wholesale platform at: www.b2b.liovela.sk

2. The Customer may make a purchase:

       after logging into their account,

       as a guest (without registration) – upon acceptance of the Terms and Conditions each time.

3. The order process includes:

       reading the product description,

       adding selected products to the cart,

       selecting the delivery method,

       selecting the payment method,

       entering recipient details,

       reviewing the order summary,

       confirming the order using the "Buy and Pay" button.

4. After placing an order, the Customer will receive confirmation of the contract conclusion at the provided e-mail address.

5. The order is valid for 5 calendar days from the date of its processing. In the event of failure to collect the goods, non-payment or inability to contact the Customer, the Seller may cancel the order.

6. The Seller may designate selected products as special offers or promotions. Detailed conditions of special offers (including covered products, quantity limits per Customer and estimated processing time) are published on the Store's website.

7. Customers with an account may use a loyalty programme based on a points system redeemable for discounts. Programme details are available at www.liovela.sk/vernostny-program. Loyalty points cannot be combined with special offers.

V. Delivery

1. The Seller ships throughout the entire EU.

2. Available delivery methods:

       courier,

       parcel locker (DPD, POST, PACKETA and others),

       collection points (DPD, POST, PACKETA and others).

3. Current delivery costs are available at: https://www.liovela.sk/delivery

4. The standard order processing time is 3 working days. If the waiting time is longer, this information is included in the product description.

5. Collection of the parcel by the Customer or a designated person (excluding the carrier) means the transfer of ownership of the goods to the Customer making a consumer purchase. From that moment the Customer is responsible for any damage to or loss of the goods.

6. In the event of damage or incomplete delivery, it is recommended:

a. For courier delivery: drawing up a damage report with the courier and filing a complaint with the carrier within 7 days of receipt, or contacting the Seller at: liovela@liovela.com (preferably within 24 hours).

b. For parcel locker delivery: recording the damage in front of the security camera, leaving the undamaged parcel in the compartment and filing a complaint with the parcel locker operator or the Seller at: liovela@liovela.com.

7. If an order is split into multiple shipments, the delivery cost shown in the order summary remains unchanged.

8. If fulfilment of the order in the originally selected range is not possible, the Seller may propose substitute goods of equivalent quality, purpose and price. The Customer has the right to accept or reject such a proposal.

VI. Payments

1. Product prices are given in euros (EUR) and include VAT. Delivery costs are not included in the product price.

2. Available payment methods:

       online bank transfer or payment card (Visa, Mastercard and others) – prepayment,

       BLIK – prepayment,

       traditional bank transfer,

       payment on delivery (cash or card).

3. Online payment processing is provided by Comgate A.S.

4. Invoices are issued in electronic form and sent to the Customer's e-mail address. A Customer who is a consumer may request a paper invoice with each order.

5. The electronic invoice for Customers making consumer purchases is sent to the e-mail address provided when placing the order or during registration. If the e-mail address changes, the Customer is obliged to notify the Seller immediately. Correspondence sent to the previous address is considered duly delivered.

6. Business customers receive invoices electronically at the e-mail address provided when placing the order, in accordance with the provisions of the Value Added Tax Act.

7. The Seller is not responsible for errors in the invoice data resulting from incorrect information provided by the Customer.

8. Refunds in connection with withdrawal from the contract or acceptance of a complaint will be made using the same payment method the Customer used for the purchase.

VII. Right of Withdrawal

1. A Customer making a consumer purchase through the Store (distance contract) has the right to withdraw from the contract without giving a reason. The provisions of this section apply exclusively to consumer purchases.

2. The right of withdrawal may be exercised within 14 days of the date of receipt of the goods by the Customer or a designated third party (excluding the carrier).

3. The withdrawal statement must be sent:

       by e-mail to: liovela@liovela.com,

       by post to: LIOVELA s.r.o., ul. Dlha 561/67, 08901 Svidnik, Slovakia.

4. The right of withdrawal does not apply to:

a. services fully performed with the Customer's explicit consent, where the Customer was informed of the loss of the right of withdrawal before the service was provided;

b. goods manufactured to the Customer's individual specifications or clearly tailored to the Customer's individual needs;

c. goods delivered in sealed packaging for hygienic or health reasons, if the Customer has opened the packaging;

d. goods which, after delivery, by their nature become inseparably mixed with other items;

e. goods subject to rapid deterioration or with a short shelf life.

5. If the returned goods were used in a manner exceeding what is necessary to verify their characteristics and functionality, the Customer is liable for any reduction in their value.

6. The returned goods must be sent back promptly, no later than 14 days from the date of notification of withdrawal. Products purchased as a set may only be returned as a complete set. Withdrawal from the main contract also covers all ancillary contracts.

7. The direct costs of returning the goods are borne by the Customer.

8. The refund of delivery costs is limited to the amount corresponding to the cheapest standard delivery option offered by the Seller, even if the Customer chose a more expensive variant.

VIII. Complaints Procedure

1. The Customer has the right to file a complaint regarding purchased goods.

2. A complaint on grounds of liability for defects (non-conformity of goods with the contract) may be submitted in any form. For efficient processing, it is recommended to submit it by e-mail to: liovela@liovela.com

3. Upon receipt of the e-mail, the Customer will be informed of the next steps.

4. The complained goods must be sent to: LIOVELA s.r.o., OD PROFIT, ul. Sovietskych hrdinov 627/37, 1st floor, 08901 Svidnik, Slovakia.

5. The complaint is processed within 14 days of receipt of the notification by the Seller.

6. The complained goods may be collected at the place and in the form in which they were delivered to the Seller.

7. Some products offered in the Store may be covered by a manufacturer's, importer's or Seller's warranty. Detailed warranty conditions are set out in the warranty card enclosed with the product. The Customer may exercise the warranty even without the warranty card. This provision does not exclude, limit or suspend rights arising from the provisions on liability for defects.

8. For purchases made by business customers who are not consumers, the parties exclude the Seller's liability for defects, including liability for hidden defects. This exclusion does not apply to consumer purchases.

9. A Customer making consumer purchases has the right to use out-of-court dispute resolution methods, including by submitting a request to the Slovak Trade Inspection (SOI). The supervisory authority and alternative dispute resolution body is the SOI Inspectorate for the Presov Region (address: Obrancov mieru 6, 080 01 Presov, e-mail: pr@soi.sk). The Customer may also use the European Online Dispute Resolution (ODR) platform, available at: https://ec.europa.eu/consumers/odr

IX. Protection of Personal Data

1. Customers' personal data are processed in accordance with applicable law and the Seller's Privacy Policy, available at: https://www.liovela.sk/ochrana-osobnych-udajov

2. Personal data are processed in the following cases:

a. processing orders and handling transactions;

b. use of services available in the Store;

c. carrying out marketing activities – upon the Customer's relevant consent;

d. fulfilment of the controller's legitimate interests, including handling claims.

3. Providing personal data is voluntary but necessary for the provision of the Store's services.

4. The controller of Customers' personal data is LIOVELA s.r.o., ul. Dlha 561/67, 08901 Svidnik, Slovakia.

5. The Customer has the right to access their personal data, to rectify, erase or restrict its processing, as well as the right to data portability, to object and to lodge a complaint with a supervisory authority. Consent given may be withdrawn at any time without affecting the lawfulness of processing carried out prior to its withdrawal.

X. Amendments to the Terms and Conditions

1. The Seller reserves the right to amend these Terms and Conditions. The amended version will be published in the Store at least 7 days before the date of entry into force. Exceptions are situations where:

a. the change is required by a legal or regulatory obligation requiring immediate action;

b. the purpose of the change is to protect Customers from fraud, malware, spam, data breaches or other cybersecurity threats.

2. Customers with an account in the Store will be informed of the change to the Terms and Conditions upon their next login and asked to accept them. Failure to accept will result in being logged out; the Customer may then continue shopping as a guest.

3. Orders placed before the date on which the new provisions of the Terms and Conditions enter into force will be fulfilled under the previous rules.

4. An amendment to the Terms and Conditions does not affect the acquired rights of Customers using the Store.
